Nebraska Uninsured and Underinsured Motorist Coverage Lawyers

A study conducted in Nebraska a few years ago estimated that between 20 and 30 percent of drivers in the Omaha metropolitan area were either uninsured or underinsured. This means that either those drivers had no insurance to pay compensation to those who they've injured, or they had too little insurance.

If you have been injured by a driver with no insurance or not enough insurance, you can seek compensation from your own uninsured and underinsured motorist (UM/UIM) coverage.

Most people don't even know they have UM/UIM coverage. However, by law in Nebraska, if you purchase auto insurance, you also purchase UM/UIM coverage.

UM/UIM coverage provides compensation for medical bills, lost wages, pain and suffering, and all the other damages injury victims receive, up to the limits of your coverage. The difference between uninsured and underinsured coverage is that underinsured coverage doesn't kick in until after you have exhausted the insurance of the person who caused the accident.

People often don’t think of turning to their own insurance company for help if they've been injured in an accident because they think it will affect their premium. However, what usually happens is that your insurance company will make a settlement with you and then go after the deadbeat who had no insurance or not enough insurance and obtain a judgment against that person.

There is an important difference in the obligation your own insurance company owes to you and the obligation another driver's insurance company owes you. The other driver's insurance company can treat you like an adversary. However, your own insurance company has a legal duty to be honest, fair, and objective in dealing with you. If your insurance company doesn't treat you fairly, they could be responsible for extra damages for insurance bad faith.

Our lawyers not only pursue insurance claims for uninsured and underinsured, but we also pursue those cases where our clients were treated unfairly by their insurance company. If we sue your insurance company and recover more than they offered you, an extra award of attorney fees can be added to your recovery.

If your insurance company is not treating you fairly, you may be the victim of an illegal and arbitrary claims practice. Our lawyers are currently handling a class action lawsuit against State Farm Insurance for an institutional practice of treating their customers unfairly.
