Nebraska Social Security Disability Lawyer

If you are disabled due to an injury or medical condition and unable to work for 12 months or longer, you can apply for benefits from Social Security. Social Security includes two types of disability benefits:

  • Social Security Disability (SSD) for people who have been working and paying into the system
  • Supplemental Security Income (SSI) for people who have not worked long enough to qualify for Social Security Disability

When you file a disability claim, you may need a lawyer to protect your interests, especially if you are under age 50 or have a disability that is less obvious. Generally, there are three stages in any disability claim:

  1. The first stage is filing an application with the Social Security Administration. With your application, you need to include medical records to document your disability. While you may be successful in obtain benefits, you should be aware that most applications are denied.
  2. You can then apply for reconsideration of that decision and submit additional medical documentation. In most cases, however, this leads to a second denial.
  3. Finally, you can request a hearing before an administrative law judge.

Our Social Security Disability lawyers can help you at any stage in the process. Most people wait and contact us at stage 3, after they have already had their disability claim denied twice. However, it may be to your advantage to hire an attorney earlier in the process. Nebraska is one of the most backed-up states in the union for SSD and SSI applications. By hiring an attorney who is experienced with Social Security regulations and guidelines, you may be able to avoid the long delays that come from having your initial application turned down.

We offer a free initial consultation to explain your rights. If you retain us to represent you, our fee would be 25 percent of your benefits, up to the cap allowed by Social Security (approximately $4,000). If we advance expenses to prove your case, you would also owe us expenses.
