Nebraska Insurance Claims Lawyer

When disaster strikes, people expect their insurance company to live up to the terms of their policy and cover the loss. Most people aren't prepared to be victimized a second time by the insurance company.

At Kelley & Lehan, our attorneys often represent people in claims against insurance companies. We are experienced in representing people who are victims of theft, break-ins, fire, flood, roof damage, and storm damage. We offer a free initial consultation to discuss your rights.

When you file an insurance claim, you may find yourself in need of a lawyer to protect your interests. People who file homeowner claims for theft or other types of loss almost invariably accused of exaggerating their losses by their insurer. To support this allegation, the insurance company may scrutinize your credit card bills and other financial records to claim you had a financial motive to submit a fraudulent claim.

The insurance adjustor may force you to make a recorded statement or sign your proof of loss form under oath. Then the insurance company can request that you take an examination under oath. If you say anything during this examination that is inconsistent with your proof of loss form or recorded statement, that statement can be used against you to claim you committed insurance fraud. Few people realize they have a right to request a copy of their proof of loss form and transcript of their recorded statement and review it before taking an examination under oath. It is important to get a lawyer's advice whenever the relationship between you and your insurance company turns adversarial.

While disputes are most common in homeowner policies, our attorneys are experienced in helping people with disability, life, and UM/UIM claims as well.

Your insurance company has a legal duty to be honest, fair, and objective in dealing with you. If your insurance company rejects a claim arbitrarily or otherwise fails to treat you fairly, you can sue your insurance company for additional damages for breach of contract and/or insurance bad faith.
